  1. Acceptance of Terms

    These Terms of Service govern your access to the website and services of Thermara Brands LLC. By using the website, requesting a quote, scheduling work, or purchasing services, you agree to these Terms. If you do not agree, do not use the website or services.

  2. Description of Services

    Thermara Brands LLC designs, sells, installs, programs, services, repairs, and expands permanent LED roofline, storefront, landscape, soffit, and accent lighting systems. Quotes, timelines, layouts, colors, equipment, and warranty coverage are confirmed in a written proposal or service agreement.

  3. User Responsibilities

    You agree to provide accurate contact and property information, ensure lawful access to the work area, disclose known hazards, and obtain any owner, landlord, homeowners association, architectural committee, or municipal approval required for the lighting. You are responsible for following HOA covenants and municipal lighting, electrical, sign, nuisance, and permitting rules unless our written agreement expressly assigns a requirement to us.

  4. Payment Terms

    Prices, deposits, milestones, taxes, accepted payment methods, and due dates are stated in the written proposal. Past-due balances may delay scheduling or service. Additional work requested after approval may require a written change order and additional payment.

  5. Intellectual Property

    The website, brand, copy, graphics, installation plans, photographs, and other materials supplied by Thermara Brands LLC are owned by us or our licensors and protected by applicable intellectual-property laws. You may not reproduce, distribute, or commercially exploit them without written permission.

  6. Limitation of Liability

    To the fullest extent permitted by law, Thermara Brands LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, loss of use, or lost profits arising from the website or services. Our aggregate liability for a claim will not exceed the amount you paid us for the service giving rise to that claim. Kansas law may preserve rights that cannot lawfully be limited.

  7. Disclaimer of Warranties

    Except for any written workmanship warranty included in your signed proposal or service agreement, the website and services are provided on an “as available” basis to the fullest extent permitted by law. We disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. This disclaimer does not reduce or replace the express written workmanship warranty we give you.

  8. Indemnification

    You agree to indemnify and hold Thermara Brands LLC and its members, employees, and contractors harmless from claims, losses, and reasonable costs arising from your misuse of the website or services, inaccurate information, unauthorized property access, or violation of applicable rules or these Terms.

  9. Termination

    We may suspend website access, communications, scheduling, or services when reasonably necessary for safety, nonpayment, unlawful conduct, abuse, or a material breach of these Terms. Obligations that by their nature should survive termination, including payment, ownership, liability, and dispute provisions, will survive.

  10. Governing Law

    These Terms are governed by the laws of the State of Kansas, without regard to conflict-of-law principles. Any dispute not resolved informally must be brought in a court of competent jurisdiction located in Johnson County, Kansas, and each party consents to that venue.

  11. Changes to Terms

    We may revise these Terms as our services or legal obligations change. The revised version will display a new “Last Updated” date and applies prospectively when posted. Continued use after posting constitutes acceptance of the revised Terms.

  12. SMS Messaging

    If you separately opt in, Thermara Brands LLC may send SMS messages to the number provided for quote follow-ups, appointment confirmations and reminders, installation and service updates, and occasional promotional communications or seasonal offers. Message frequency varies, up to 10 messages per month. Message and data rates may apply. Reply STOP to opt out or HELP for assistance. Consent is not a condition of purchase.
